Terms and Conditions

This website (Website) is owned by Bremner Technology (ABN 37 733 582 421). By using this Website and/or purchasing any Products or Managed Services (Services) you agree to the Terms and Conditions below and acknowledge that you have read and understood and agree to be bound by these Terms and Conditions. Bremner Technology may amend these Terms and Conditions from time to time without notice. Your continued use of this Website and any Services after any amendment becomes effective constitutes an agreement by you to abide and be bound by these Terms and Conditions, as amended.

Performance of Services

As a technology services reseller, Bremner Technology is not directly responsible for the performance or availability of hosting services. These services are provided in accordance with their own Terms and Agreements: At the time of entering into an Agreement for the provision of services, Bremner Technology will provide you with an estimated date on which the services will be completed. Although Bremner Technology will use all reasonable endeavours to meet the time frame provided, on occasions circumstances may arise where it will not be possible to complete the services by the estimated completion date. Should this occur, Bremner Technology will notify you of the delay and provide you with a new estimated completion date.

Quotes

Any quotations given by Bremner Technology are given as a guide based on the limited information given by you. A verbal quote is intended to give you an estimate of the price, and is not an assurance that the product or service will be sold at that price. Any written quote given by Bremner Technology is a guarantee that the product or service will be provided at that price. Any written quote is valid for a period of 7 days. Any piece of advertising material stating a fixed price for a product or service is valid only for the period stated on the advertising material.

Service Charges and Payment

Fees for hosting/subscription services are charged monthly and payable on the start of every calendar month. First time setup will incur a pro-rated charge for the remainder of the calendar month before moving to the standard charge schedule. Payment for non-hosting/subscription services must be made in full at the conclusion of the service. At this time, Bremner Technology only accepts cash payments. A receipt can be provided for all services performed.

Liability

Bremner Technology will not be liable to you or to any other person for any loss or damage (whether direct, indirect, consequential or economic), however caused and whether by negligence or otherwise consequential or indirect which includes, but is not limited to:
  • Interruption to services
  • Damage to hardware or property
  • Corruption or damage to software
  • Data loss or data corruption
  • Personal injury

This section explains how Bremner Technology handles personal information and complies with the requirements of privacy law including the Privacy Act 1988 (Cth).

What information we collect

Personal information held by Bremner Technology may include your name, date of birth, current and previous addresses, contact phone numbers, email address and the details of suppliers in their dealings with Bremner Technology.

How we collect information

Personal information is collected by Bremner Technology to enable us to provide you with the products and services you have requested and to assist us to improve our products and services. If you choose not to provide personal information, we may not be able to provide you with the products and services you require. Any personal information will only be collected directly from you via email, mail or phone for products or services at the time of providing quotations or creating agreements for the provision of our services.

How we will use this information

Any personal information collected by Bremner Technology will only be used for the purpose that you have provided it for. We will not use this information for any other purpose and will not provide it to any other third party without your consent.

As a technology services reseller, your data and information may be collected by other parties for the provision of services. How these other parties manage your Privacy are outlined in their own policies:

Warranty and Maintenance

Warranty and Maintenance

In addition to some products and services, Bremner Technology may offer an additional Warranty and/or Maintenance. These may come included as a package, or are available as a paid add-on to enhance your product or service. This section will detail the difference between both offerings and detail their inclusions.

Warranty

Within a specified period of time after the purchase of some products, a warranty period will apply. This period of time varies between products, please see individual products for specific times. Items that are covered by warranty include:
  • Fix issues with existing content. Eg: Formatting, typos
  • Fix errors with software. Eg: Misbehaving plugins
  • Fix navigation issues. Eg: Orphaned web pages, broken menus
Items that are not covered by warranty include:
  • Move, Add, Change or Delete content
  • Issues caused by account compromise or poor security practices. Eg: Website hijacking

Maintenance

Maintenance is an optional add-on to enhance a product or service with additional support, features, compatibility, and updates. Maintenance includes the following:
  • Fix issues with existing content. Eg: Formatting, typos
  • Fix errors with software. Eg: Misbehaving plugins
  • Fix navigation issues. Eg: Orphaned web pages, broken menus
  • Website software and plugin updates
  • Minor website changes. Eg: Publish new articles/pages/blogs when provided with the content, update contact details
  • Website optimisations and security checks
Not included:
  • Major website changes. Eg: Extensive design work
  • Issues caused by account compromise or poor security practices. Eg: Website hijacking
  • Ongoing SEO campaigns
Where reasonable efforts to secure and protect products (websites or other hosting services) have not been made, Bremner Technology reserves the right to refuse to provide warranties, support or maintenance for any product or service. A quote for this kind of work can be provided upon request.
